In most jurisdictions, yes. Modern e-signature laws follow the same core principle: a signature cannot be denied legal effect solely because it is electronic. What matters is proving who signed, what they signed, and that the document has not changed since.

  • Kenya — KICA (Kenya Information and Communications Act): recognizes electronic signatures and electronic records as legally valid, supported by the Business Laws (Amendment) Act.
  • European Union — eIDAS: establishes simple, advanced, and qualified electronic signatures, all with legal effect across member states.
  • United States — ESIGN Act & UETA: give electronic signatures the same legal standing as handwritten ones in nearly all commercial transactions.
  • South Africa — ECTA, Nigeria — Evidence Act, and similar statutes across Africa recognize electronic signatures for most agreements.

3. What courts look for

  • Intent — the signer meant to sign and understood they were signing.

  • Integrity — proof the document was not altered after signing.
