Terms of Service

Effective date: 13 July 2026

These terms are a binding agreement between you and Skyfalke Limited governing your use of the Skyfalke Sign platform. By creating an account or signing a document through the service, you accept them.

1. The service

Skyfalke Sign (the “Service”) is an electronic signature platform operated by Skyfalke Limited, Nairobi, Kenya (“Skyfalke”, “we”, “us”). It lets you upload documents, send them for electronic signature, sign documents sent to you, and store the completed records with their audit trails.

2. Accounts

  • You must provide accurate information when registering and keep it up to date.
  • You are responsible for safeguarding your login credentials and for all activity under your account.
  • One person may not share a single-user account; organization plans define how many team members may be added.
  • You must be at least 18 years old and legally capable of entering into contracts.

3. Electronic signatures

Electronic signatures executed through the Service are intended to be legally binding under the Kenya Information and Communications Act (KICA), and equivalent laws in other jurisdictions such as the US ESIGN Act, the EU eIDAS Regulation, and the UK Electronic Communications Act. By signing through the Service you consent to transact electronically.

Some document types are excluded from electronic execution in certain jurisdictions (for example wills, some property transfers, and certain court documents). You are responsible for confirming that electronic signature is legally permitted for your specific document and jurisdiction. Skyfalke does not provide legal advice.

4. Your content

  • You retain all rights to the documents you upload. We claim no ownership of your content.
  • You grant us a limited licence to store, process, and transmit your documents solely to provide the Service (for example, rendering them to signers and compiling the signed copy).
  • You are responsible for the content of your documents and for having the right to share them with the recipients you invite.
  • We handle personal data as described in our Privacy Policy.

5. Acceptable use

You agree not to use the Service to:

  • Break any law, or send documents that are fraudulent, defamatory, or infringe others' rights.
  • Impersonate another person, or sign on behalf of someone without authority to do so.
  • Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure.
  • Resell, sublicense, or provide the Service to third parties except as permitted by your plan.
  • Interfere with the operation of the Service, including by transmitting malware or placing unreasonable load on it.

We may suspend or terminate accounts that violate these terms. Where practical, we will notify you and give you an opportunity to remedy the violation first.

6. Plans, billing, and credits

  • Paid plans are billed in advance, monthly or annually, in Kenya Shillings (KES) unless stated otherwise. Payments are processed by M-Pesa, PayPal, or card providers.
  • Free trials convert to a limited state when they end; your documents remain accessible but sending may be restricted until you subscribe.
  • Plan limits (documents, users, storage) are described on the pricing page. Pay-as-you-go document credits do not expire.
  • Fees are non-refundable except where required by law or expressly stated. If we materially fail to provide the Service, contact support and we will put it right or refund the affected period.
  • We may change prices with at least 30 days' notice; changes apply from your next billing cycle.

7. Cancellation and termination

  • You may cancel your subscription at any time; the Service remains available until the end of the paid period.
  • After closure of an account we retain data only as described in the Privacy Policy. Export your documents before closing your account.
  • We may terminate or suspend the Service for material breach of these terms, non-payment, or where required by law.

8. Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted operation. Planned maintenance will be announced where practical. Support is available at support@skyfalke.com.

9. Disclaimers and liability

The Service is provided “as is”. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we are not liable for indirect, incidental, or consequential losses, or loss of profits, data, or goodwill.

Our total liability arising out of or relating to the Service in any 12-month period is limited to the amount you paid us for the Service during that period. Nothing in these terms excludes liability that cannot be excluded under applicable law, including under the Consumer Protection Act of Kenya.

10. Governing law and disputes

These terms are governed by the laws of Kenya. Disputes will be subject to the exclusive jurisdiction of the courts of Kenya, sitting in Nairobi, after a good-faith attempt to resolve the matter directly with us first.

11. Changes to these terms

We may update these terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continuing to use the Service after changes take effect constitutes acceptance.
